Need health and medical help about malpractice in a surgery

A patient undergoing surgery is given an anesthetic, which due to a previous treatment the patient received poses an increased risk of use because of the possibility that the anesthetic could react with her current medications. The patient was advised of these risks but consented to the anesthetic’s use anyway. As a result of using the anesthetic, the patient suffers liver damage and dies. Would this be an example of malpractice or negligence? Be sure to explain your choice. Could the patient’s family expect to receive any kind of compensation? If so, what kind?
