Ant response, Hall D. & Feldmeier J. (2012). Constitutional Law Government Powers and Individual Freedoms Second Edition. Upper Saddle River. Pearson Education.

Article I, Section 8, of the United States Constitution deals with Illegal immigration on a federal, state, and local authority level. “This provision, in combination with many other provision delegating foreign affairs powers to the United States, makes it clear that immigration and naturalization are largely federal policy issues. And indeed, the United Stated has regulated immigration since the early days of the Constitution, beginning with the Alien Act of 1798” (Hall & Feldmeier, 2012). There was a loophole, the federal government has 100 percent jurisdiction  over what happen to illegal immigrants but has no authority over how illegal immigrants come into custody. Although I disagree with the methods use by Arizona laws, I’m afraid this is the way our politics works, finding finding loopholes in or around the constitution.

The fact that police department build a branch of a department to deal with the growing numbers of immigration is key. Building a department that is able to work whit the community. “Their attempts to professionalize police, which would have made it easier to control immigration arguably failed as well” (White, 2007). Trying to use police officer to control immigration will not work it will only send the problem to another state.
